This Distance Sales Agreement (“Agreement”) governs purchases made through ARKAD STONE GALLERY, operated by ARKAD MAKİNA SANAYİ İÇ VE DIŞ TİCARET LİMİTED ŞİRKETİ, through the website galleryarkad.com.

By completing an order through the website, the customer acknowledges that they have reviewed the product information, price, shipping terms, applicable policies, and the terms of this Agreement before completing the purchase.

Buyer

The Buyer is the individual or legal entity purchasing goods through the website.

The Buyer's name, billing address, delivery address, email address, telephone number where provided, and other order information are the details entered by the Buyer during checkout.

2. Subject of the Agreement

The purpose of this Agreement is to establish the terms and conditions applicable to the distance sale and delivery of products ordered electronically by the Buyer through ARKAD STONE GALLERY.

The product description, material, dimensions, quantity, sale price, shipping charges where applicable, payment information and other relevant order details displayed on the product page and at checkout form an integral part of this Agreement.

3. Product Characteristics

ARKAD STONE GALLERY offers handcrafted products manufactured primarily from natural stone materials including marble and travertine.

The essential characteristics of each product are displayed on the relevant product page.

Natural stone is inherently unique. Variations in:

• color
• veining
• texture
• pores
• fossils
• pattern
• surface characteristics

are natural features of the material and are not considered defects.

Customers acknowledge that the delivered natural-stone product may exhibit reasonable natural variations compared with photographs, samples or previously produced pieces.

4. Price and Payment

The applicable product price is the price shown to the Buyer at the time the order is placed.

Before payment is completed, the Buyer will be shown the applicable product price and, where relevant:

• shipping charges
• taxes collected at checkout
• discounts
• additional charges known at the time of purchase

Payments may be processed through payment service providers made available on the website.

The order becomes effective after successful payment authorization and order confirmation.

5. International Sales

ARKAD STONE GALLERY primarily sells products internationally, including to customers located in the United States, United Kingdom, European countries and other international destinations.

The Buyer is responsible for providing accurate shipping and contact information.

Orders may be shipped through international carriers including DHL, FedEx, UPS or another suitable logistics provider selected according to the destination, size, weight and nature of the product.

6. Customs Duties and Import Charges

7. Production and Delivery

Custom, personalized and made-to-order products generally require approximately 30 days for production.

Certain complex products may require additional production time depending on:

• design complexity
• finishing requirements
• customization requested by the Buyer

Where a significant delay occurs, the Seller will make reasonable efforts to inform the Buyer.

Estimated delivery times are not absolute guarantees where delays arise from circumstances outside the Seller's reasonable control.

8. Custom and Made-to-Order Products

A product will be considered customized or made-to-order when it is manufactured according to specifications individually requested or approved by the Buyer, including but not limited to:

• custom dimensions
• specific stone selection
• customized material
• finish
• design
• structural changes
• other personalized requirements

Once production has commenced, customized products generally cannot be cancelled, returned or exchanged except where:

• the product is defective;
• the product was damaged during delivery;
• the Seller delivered the wrong product;
• the product materially differs from the specifications expressly agreed with the Buyer; or
• mandatory applicable law provides otherwise.

The Buyer is responsible for carefully reviewing and approving custom dimensions and specifications before production begins.

9. Withdrawal and Returns for Standard Products

For standard and non-customized products, any statutory withdrawal or cancellation rights available to the Buyer will be respected in accordance with mandatory consumer protection laws applicable to the transaction.

Customers in jurisdictions including the European Union and United Kingdom may have statutory withdrawal rights for qualifying distance purchases.

Where such rights apply, the Buyer must notify ARKAD STONE GALLERY within the legally applicable period.

Returned products must be handled in accordance with the Shipping & Returns Policy published on the website.

10. Return Shipping Costs

For eligible returns involving a product that is not defective and was correctly supplied, return shipping costs are the responsibility of the Buyer, unless mandatory applicable consumer law requires otherwise.

Where a product is defective, incorrectly supplied or damaged in circumstances for which the Seller is responsible, the appropriate return, replacement or refund arrangements will be evaluated by the Seller.

Because natural-stone products can be heavy, fragile and require specialized packaging, the Buyer must contact ARKAD STONE GALLERY before returning any item.

Products should not be returned without prior return instructions.

11. Products Damaged During Transportation

The Buyer is requested to inspect the shipment immediately after delivery.

If the product is visibly broken or damaged during transportation, the Buyer should, whenever reasonably possible, notify ARKAD STONE GALLERY within 48 hours of delivery at:

The Buyer should provide:

• order number
• photographs of the damaged product
• photographs of the outer packaging
• photographs of the inner packaging
• a brief description of the damage

This 48-hour notification request is intended to facilitate transportation and insurance claims and does not limit mandatory rights granted by applicable law.

12. Refunds

Where a refund is approved, the refund will generally be made to the original payment method used by the Buyer.

Processing times may depend on the payment provider, financial institution and jurisdiction.

Unless mandatory applicable law provides otherwise, customs duties, import taxes, brokerage fees and certain third-party charges may not be refundable by the Seller.

13. Buyer Obligations

The Buyer confirms that:

• the information supplied when placing the order is accurate;
• the Buyer has reviewed the product description and specifications;
• the Buyer understands the natural characteristics of stone products;
• the Buyer has reviewed applicable shipping and return terms before purchasing;
• custom specifications submitted or approved by the Buyer are accurate.

The Buyer is responsible for any consequences resulting from materially incorrect delivery information provided during checkout.

14. Seller Obligations

The Seller agrees to supply the product in accordance with the order and applicable mandatory laws.

Where the Seller is unable to perform the order due to a material issue, the Seller will contact the Buyer and, where appropriate, provide a reasonable remedy.

15. Force Majeure

Neither party will be responsible for delays or failure to perform caused by events reasonably beyond their control, including but not limited to:

• epidemics or similar emergencies
• major supply interruptions

Where mandatory consumer protection rules in the Buyer's country apply to the transaction, those mandatory rights remain unaffected.

18. Acceptance

By placing an order on galleryarkad.com, the Buyer confirms that they have had the opportunity to review:

• the product information;
• the total price shown at checkout;
• applicable shipping information;
• the Shipping & Returns Policy;
• the Privacy Policy; and
• this Distance Sales Agreement

before completing the purchase.
